Is It Technically Legal in Texas?

Rumors or misconceptions can alter Texans' consensus of the law.  As stated on the Alcohol Policy Information System web page, it attempts to clear up any misconceptions about what is legal in Texas.

Shockingly, yes! Yes, it is legal to take your child to the bar as long as they are visibly within your presence.  This only applies if you are the parent, guardian, or spouse of the minor in question.

Can Minors Drink Alcohol?

This is another one of those shocking "yes!".  In Texas, you can legally give your minor alcohol with the strict notion that you have to be visibly watching them.  However, this also implies that you have to be the minor's parent, guardian, or spouse.  Anyone who gives a minor alcohol who does not fall under those guidelines can face a Class A misdemeanor charge, which may include up to a year in jail and a $4,000 fine.

Before You Attempt to Take Your Child Barhopping

Before you think you have a new drinking buddy, there is something you should know.  It should be noted that most establishments will not allow the minor to enter the premises, despite it being perfectly legal in the state.  Businesses are not obligated to comply.  This is usually to avoid liability, confusion, or risk.  So, just because it's legal, does not mean that you can bar hop freely with your minor in tow.
