Serenity Memorial Gardens in Scott, Louisiana

In 2024, a new cemetery was opened in Scott, Louisiana, located on Willow Street near Scott.

The cemetery, Serenity Memorial Gardens, is owned by GRAMMY Award-winning local musician Kevin Menard.

According to KADN, Menard received a state license to start the cemetery, but Lafayette Consolidated Government claims Menard never received the proper local permits.

As such, LCG has issued a cease-and-desist order ordering Menard to stop burying bodies at the cemetery immediately.

What Permits Are Needed To Open A New Cemetery?

As you can imagine, when it comes to opening a new cemetery in Louisiana, or anywhere for that matter, there are quite a few strict law, guidelines, and permits that must be obtained.

Though these laws and permits can vary state to state and even city to city, these are the more common ones that need to be obtained.
1. Zoning & Land Use Approvals

Some areas require additional approvals for cemeteries.

If required, this assesses the impact on groundwater, soil, and nearby properties.

2. Business & Operational Permits

Most states require a license to operate a cemetery, issued by a state funeral or cemetery board.

3. Health & Environmental Permits

Extensive tests are required to prevent contamination of water sources.

4. Construction & Development Permits

Building permits will be required If constructing mausoleums, chapels, or other structures.

5. State-Specific Requirements

Some states require a Perpetual Care Fund to ensure long-term maintenance.
